H.R. 30, the Save American Workers Act

Repealing Obamacare's 30-hour definition of full-time employment

On January 6, 2015, Reps. Todd Young (IN-9) and Dan Lipinski (IL-3)—on behalf of themselves and Reps. Pete Olson (TX-22), Mike Kelly (PA-3), and Tim Walberg (MI-7)—led a bipartisan effort to introduce H.R. 30, the Save American Workers (SAW) Act, a bill that would repeal the 30-hour definition of "full-time employment" in the Affordable Care Act and restore the traditional 40-hour definition. The bill was introduced with 145 co-sponsors. Sens. Susan Collins, Joe Donnelly, Lisa Murkowski, and Joe Manchin are expected to introduce similar bipartisan legislation in the Senate. Statement from Rep. Young: "When the employer mandate became effective on January 1, up to 2.6 million Americans were at-risk for seeing lost hours and wages at work. Ironically, this unintended consequence hurts most those Obamacare was claimed to help: low- and middle-income Americans working hourly jobs. Repealing this provision and restoring the traditional understanding of a forty-hour work is necessary to protect their paychecks. By making this one of the first votes of the new Congress, the House of Representatives is making clear our desire to provide relief from the most egregious unintended consequences of this law. I’m pleased that Rep. Lipinski and a growing number of Democrats are joining such efforts."

Statement from Rep. Lipinski: "In 2013, I introduced the Forty Hours is Full Time Act to change the ACA's definition of full time work from 30 to 40 hours. Last year, I joined with Rep. Young on his Save American Workers Act to make a bipartisan push to a floor vote on this commonsense issue and the bill passed out of the House. This needed change to the ACA will protect part-time workers from losing work schedule flexibility and potentially losing 10 hours of wages a week. I am hopeful that the new Congress will be able to get this legislation to the President’s desk."

Statement from Rep. Olson: "Obamacare has been a train wreck for businesses and part-time employees. Reducing the definition of full-time employment to try to force more companies to participate in the new law has forced employers to reduce hours for part-time employees. This action hurts the pocketbooks of struggling families, single parents and young Americans who need to work. H.R. 30 restores the traditional 40 hour work week. Statement from Rep. Kelly: "As predicted, Obamacare is proving to be a disaster for millions of hardworking Americans. By redefining the traditional work week, the law’s employer mandate is unfairly killing jobs, cutting hours, and lowering wages all across our country, including in Western Pennsylvania, and driving a cruel wedge between employers and their trusted associates. As businesses close and parents are forced to find extra jobs to make ends meet, women and low-income workers are at the worst risk. The Save American Workers Act will repeal the law’s destructive 30-hour work week rule, and I couldn’t be prouder to be an original co-sponsor of it.
